摘要
人犬矛盾治理困局在立法规范维度表现为规范精细化程度不够、事后处罚类规则惩罚力度低、动物福利类规范供给不足;在规则执行维度表现为多头治理主体间整合力度不够、基层力量参与不足、执法能力尚有欠缺;在养犬人自律维度表现为文明养犬意识欠缺、社区配套设施供给不足。人犬矛盾治理法治化应遵循利益平衡原则、协同治理理念以及人与自然和谐共生价值追求,结合新时代“枫桥经验”:在立法规范维度,细化相关规则,加大事后处罚力度,补充并完善动物福利类规则;在规则执行维度,利用既有制度强化多元主体间的沟通对接,丰富治理方式,加强常态化管理与日常监督巡查,在理念、装备、技能等方面提升执法能力;在养犬人自律维度,将违规行为纳入个人征信系统,完善文明养宠配套设施。
The dilemma of the rule of law in the governance of human-dog conflicts is mani-fested in three aspects.At the level of legislative norms,the precision of the content of existing rules is insufficient,and the punishment in the ex post facto punishment rules is weak.Additionally,animal welfare rules are rare.At the level of implementation of the rules,multi-subject cooperation is not enough.Meanwhile,grassroots participation is insufficient,and the law enforcement capacity is weak.At the level of the self-discipline of the public,people lack awareness of civilized dog-keeping.Community facilities are also in short supply.Among the principles of the rule of law in the governance of human-dog conflicts,the principle of balance of interests is the first to be followed,and collaborative governance requires multiple subjects to cooperate with each other.Harmonious co-existence between humans and nature can also be regarded as a specific value that needs to be pursued.Upholding and developing“Fengqiao Experience”in the governance of human-dog conflicts include the following aspects:at the level of legislative norms,the content of the rules related to the administration of dog-keeping should be refined,and the intensity of the punishment in the ex post facto rules should be increased.Animal welfare rules should also be enriched.At the level of implementation of the rules,the cooperation between multiple subjects should be strengthened based on existing systems.The governance pattern needs to be improved,including strengthening normalized management and routine supervisory inspections.Law enforcement capacity can also be enhanced through changing the law enforcement concept,ensuring the supply of law enforcement equipment,and strengthening law enforcement skills training.At the level of the self-discipline of the public,the rules of violation of the rules incorporated into the individual credit reporting system should be set.Meanwhile,the civilized pet-keeping support facilities should be improved.
