摘要
在司法实践中,将“认购碳汇”作为生态修复的补偿性、替代性重要举措,具有现实意义及生态意蕴,能够更好地发挥司法在保护生态环境方面的作用,实现生态修复的目标。通过案例分析,指出在合法性层面上,存在“认购碳汇”概念界定不统一且法律内涵缺失。“认购碳汇”案件的裁判依据合法性不足,现行规定没有弥合“认购碳汇”适用范围司法实践合法性不足的缝隙,多数判决书未依法载明生态修复方案,碳汇损失评估方法缺乏全国性统一规定且未严格依法适用,购买渠道的多元化难以保障“认购碳汇”适用的规范性等困境。要纾解其困境,应当完善适用“认购碳汇”的法律法规,在适用“认购碳汇”前制定生态修复方案,科学统一碳汇损失量计算方法和过程,以及规范“认购碳汇”的购买渠道,从而保障“认购碳汇”更好地发挥其应有的生态环境服务功能恢复效用。
In judicial practice,the subscription of carbon sinks as an important compensatory and alternative measure for ecological restoration is of great practical and ecological significance,and it can better bring into play the role of the judiciary in protecting the ecological environment and realizing the goal of ecological restoration.Through the method of normative analysis and case analysis,the article points out that at the level of legality,there exists a lack of uniformity in the definition of the concept of'subscription to carbon sink'and a lack of legal connotation.The legitimacy of the basis for adjudication of cases of'subscribing to carbon sinks'is insufficient,and the existing provisions have not bridged the gap between the legal and regulatory aspects of carbon sinks and the legal implications of carbon sinks.The existing regulations have not bridged the gap of insufficient legitimacy of judicial practice in the scope of application of'subscription to carbon sink',most of the judgments do not contain ecological restoration programs under the law,the method of assessing the loss of carbon sinks lacks national uniform regulations.It is not strictly applied in accordance with the law,and the diversification of purchasing channels makes it difficult to guarantee the norms of application of'subscription to carbon sink'and so on.To alleviate the predicament,it is necessary to improve the laws and regulations on the application of'subscription carbon sinks',formulate ecological restoration plans before applying'subscription to carbon sink',scientifically standardize the methodology and process of calculating the amount of loss of carbon sinks,and regulate the purchase channels of'subscription carbon sinks',to ensure that'subscribed carbon sinks'can give better play to their due function of restoring ecological and environmental services.
