摘要
跨境电商的迅猛发展重塑了全球贸易格局,也为服装设计领域的知识产权保护带来了新的挑战。数字技术打破了地域限制,客观上降低了侵权行为的技术门槛与监管难度,但也使得原创设计元素的非法复制、模仿及商用现象日益泛滥。部分国际电商平台因法律管辖复杂性及制度差异,客观上成为侵权行为的高发场域,权利人的维权成本显著增加,消费者权益也面临产品来源溯源不清的潜在风险。因此,就跨境电商场景下服装设计侵权行为的责任归属展开研究,以期为优化行业治理规则提供理论支撑。
The rapid development of cross-border e-commerce has reshaped the global trade pattern,and also brought new challenges to the protection of intellectual property rights in the field of clothing design.Digital technology has broken the geographical limitations,which objectively reduces the technical threshold of infringement and the difficulty of supervision,but also makes the illegal copying,imitation and commercialization of original design elements increasingly widespread.Some international e-commerce platforms,due to the complexity of the legal jurisdiction and the differences in the system,have objectively become a high incidence of infringing behaviors,and the cost of the right holder's rights has increased,and the rights and interests of the consumers are facing the potential risk of the products’source of traceability is unclear.The rights holder’s cost of defense has increased significantly,and consumers’rights and interests also face the potential risk of unclear traceability of product sources.Therefore,a study on the liability attribution of clothing design infringement in the context of cross-border e-commerce is conducted,with the expectation of providing theoretical support for optimizing the industry governance rules.
