从保障劳动者合法权益的视角论《社会保险法》覆盖范围的调整

Discussion on the Adjustment of the Coverage Scope of the“Social Insurance Law”from the Perspective of Protecting the Legitimate Rights and Interests of Laborers

摘要 《社会保险法》自2011年实施以来已超过13年,随着就业环境的变化,城镇职工群体结构发生深刻变革,出现了越来越多的灵活就业人员、实习生、离退休人员、新业态从业人员等非传统劳动关系相对固定的劳动者,他们需要并应该被纳入制度的覆盖范围。当前已有部分地区将这些从业人员纳入工伤保险的覆盖范围,这已日趋接近德国和日本等国家的社会保险覆盖范围。为了有效保障劳动者的合法权益,从《社会保险法》的立法本意出发,应进一步完善法律,弱化社会保险对劳动关系的依赖,扩大覆盖范围,借助信息技术使各险种的执行细则走向精细化。 It has been more than 13 years since the implementation of the“Social Insurance Law”in 2011.With the changes in the employment environment,the structure of urban employee groups has undergone profound transformations,and an increasing number of non-traditional laborers with relatively fixed labor relations have emerged,such as flexible employees,interns,retirees,and practitioners in new forms of business.These laborers need and should be included within the scope of the system.Currently,some regions have already incorporated these practitioners into the coverage of work-related injury insurance,increasingly approaching the social insurance coverage scopes of countries like Germany and Japan.To effectively safeguard the legitimate rights and interests of laborers,starting from the original legislative intent of the“Social Insurance Law,”it is necessary to further improve the law,weaken the dependence of social insurance on labor relations,expand the coverage scope,and refine the implementation details of various insurance types with the help of information technology.
