摘要
促进型立法领域涉及经济政策工具入法问题。一方面,经济政策工具通过入法更具有法定性、制度化与执行力;另一方面,经济政策工具在入法活动中必须面对合法性、适用性与科学性的审查,以及立法后评估的检视。从法技术构造视角看待经济政策工具入法活动,可以发现,它既表现为一项促进措施由政策性文件到规范性文件的转换过程,又表现为尝试、纠偏与学习的交互过程。经济政策工具入法的主要问题是欠缺入法前的合法性、可执行性、协调性认证,欠缺政策工具入法后作为实施手段的权义责结构性构建。主要解决途径应是在法技术构造系统性原理指导下,深化对各类入法政策工具的划定与问题检视,推动入法政策工具的分型性与协调性安排,完善入法政策工具的权义责关系构造。
The legal integration of economic policy tools constitutes a critical issue in promotive legislation.Firstly,the legislative incorporation of economic policy tools enhances their statutory validity,institutional robustness,and enforceability.Secondly,such incorporation mandates multidimensional scrutiny including legality,practical applicability,and scientific soundness,alongside compulsory post-legislative evaluation.From the perspective of legal-technical construction,it can be observed that the legislative incorporation of economic policy tools represents both a transformational process that converts promotive measures from policy guidelines into normative documents,and an interactive dynamic of experimentation,corrective adjustment,and institutional learning.The primary issues in incorporating economic policy tools into legislation lie in the lack of pre-legislative verification of their legality,enforceability,and coherence,as well as insufficient structural construction of rights,obligations,and accountability once these instruments are enacted as implementation measures.To address these challenges,a systematic legal-technical approach should be adopted.This involves refining the classification and evaluation of policy tools prior to legislative incorporation,improving their typological and coordinated arrangement,and establishing a clear framework for rights,obligations,and accountability in their legal implementation.
