摘要
随着社会观念的变迁和家庭结构的多样化,英国丧亲补助金制度改革以西奥班·麦克劳林案件为切入点,揭示其制度中存在的对非婚同居者及其未成年非婚生子女的歧视性条款。英国在丧亲补助金制度改革进程中呈现出制度内容简化、覆盖群体扩大、完善复合型权益保障以及实证研究和司法实践支撑决策的协同机制等特点,重塑法律对丧亲未成年合法权益的保护。同时,我国死亡赔偿金制度可参考该制度,通过简化程序、细分体系、更新支付方式等方式,逐步建立起“双轨制”的未成年非婚生子女的保护框架。
Triggered by the Siobhan McLaughlin case,the UK's reform of the Bereavement Support Payment system has got rid of discriminatory provisions against non-marital cohabiting partners and their minor kids.The reform demonstrates four distinctive features:content simplification,coverage expansion,protection enhancement,and a collaborative decision-making framework to reinforce legal safeguards for bereaved minors.Concurrently,China's death compensation system could learn from it by streamlining procedures,establishing a categorized framework,modernizing payment modalities to develop dual-track protection for non-marital minor children.
