摘要
检察机关实质性化解行政争议是指检察机关按照争议解决机制对行政争议进行化解,使行政争议能够在法律和事实层面得到解决,实现案结事了的目的。通过对最高检和各省检发布的典型案例进行分析,当前行政争议的复杂性与检察机关化解行政争议制度供给之间仍存在落差。依据不够明确具体,介入不同类型行政争议所受到的掣肘,化解方式的缺陷,均是检察机关化解行政争议工作持续有效进行存在的困境和短板。故应从立法层面直接赋予检察机关实质性化解行政争议的职权,细化化解手段、优化化解程序,建立实质性化解行政争议的长效机制,保障检察机关最大限度发挥职能优势,平息社会矛盾,促进案结事了政和。
The substantive resolution of administrative disputes by procuratorial organs refers to the process where procuratorial organs resolve administrative disputes in accordance with the dispute resolution mechanism,ensuring that the disputes are thoroughly and properly settled,and that they are resolved both legally and factually,achieving the goal of case closure and issue resolution.Through the analysis of typical cases released by the Supreme People's Procuratorate and provincial procuratorates,it is found that there is still a gap between the complexity of current administrative disputes and the institutional supply for procuratorial organs to resolve such disputes.The lack of clear and specific legal basis,the constraints faced when intervening in different types of administrative disputes,and the deficiencies in the resolution methods are all the difficulties and shortcomings that exist in the continuous and effective operation of procuratorial organs in resolving administrative disputes.Therefore,it is necessary to directly grant procuratorial organs the power to substantively resolve administrative disputes at the legislative level,refine the resolution methods,optimize the resolution procedures,and establish a long-term mechanism for the substantive resolution of administrative disputes,so as to ensure that procuratorial organs can maximize their functional advantages,quell social conflicts,and promote the resolution of cases and the harmony of governance.
