摘要
构筑人权“此在”世界、对话外部世界是人权话语的重要使命。在这方面,以习近平总书记关于尊重和保障人权重要论述为典范的当代中国特色人权话语表现出三重言说架构:“制度—言说”“发展—言说”与“交往—言说”。对内传播层面,集人权目的、道路、制度、实践于一体的宏观制度系统为具体社会语境及合法政治秩序中人权意涵的生成、解释、证成、延展提供了根本框架,形成了人权话语整饬表意、稳定自洽的“制度—言说”形态;人权事业发展与制度系统发展的共生关系塑造的“发展—言说”架构为我国人权话语的变迁升维注入动能,创造性地实现了“人权特殊”与“人权普遍”一元化的同构、互构,并与“制度—言说”一道共同构成了当代中国特色人权话语稳定表意和动态演进的一体两面。对外传播层面,中国以客观陈说本国参与全球人权治理现状、积极投身国际人权沟通、携手共建国际人权共识的“交往—言说”昭示本国国际人权理念及相应行动,更向世界展示了言者身份平等、言说权利对等、借自由自主沟通协商实现(各国)人权话语接合、凝汇共识表达的国际人权对话交往仪规。无论是“制度—言说”“发展—言说”还是“交往—言说”,本质上都涵映着回应现实、尊重现实并从现实中推动人权向至善状态螺旋上升的辩证思路。
Constructing a“Dasein”world of human rights and dialoguing with others are core functions of human right s discourse.In this regard,the contemporary human rights discourse exemplified by General Secretary Xi Jinping’s important statements on respecting and protecting human rights,shows three signifi cant characteristics as institutional,developmental and communicative paroles.For internal communication,the institutional parole that integrates human rights purposes,paths,systems and practices constructs a systematic framework for the aggregation,interpretation,confirmation and extension of“human rights”in specific social and political context,which lays a consistent and stable expressing foundation for human rights discourse.The developmental parole shaped by the co-existence of human rights and the institutional system,not only dynamically facilitates the evolution of the discourse,but also creatively integrates the expression s of particular and universal human rights.Moreover,the institutional and developmental paroles respectively represents the stable and dynamic expression side of contemporary human rights discourse with Chinese characteristics.For international communication,the communicative parole objectively describes what China had done and would do for international human rights issue s,and it also shows a reasonable communicative etiquette including equal rights for speakers,equal rights for speaking,and a non-prerequisite conversational atmosphere that leads consensus with no one left behind.The communicative parole and the above two paroles share the same philosophical foundation that human rights shall be defi ned and recognized within real life situations and gradually grow into ideal in a long run.
