摘要
作为“四个全面”战略布局的重要组成部分,全面依法治国是一个系统工程。将全面依法治国定位为一个系统工程,彰显了马克思主义法治理论中的系统思想,继承了中华优秀传统法律文化中的系统思维,借鉴了西方法治文明有益成果中的系统理论,贯彻了当代中国共产党人的系统观念。系统工程论贯穿于我国社会主义法治建设的始终,是经过实践检验的科学观念和思维方法。将全面依法治国视为一个系统工程加以推进,不仅遵循共产党依法执政规律,而且体现社会主义法治建设规律,还符合人类法治文明发展规律。在“四个全面”战略布局这个总系统中,全面依法治国扮演着“子系统”的角色,并对其他子系统发挥着基础性、保障性作用。系统工程论规定了推进全面依法治国的世界观与方法论,更加强调系统性的法治理念、整体性的法治要求和协同性的法治效果。在系统工程的定位下,全面依法治国要始终坚持党的集中统一领导,深刻理解“共同推进”和“一体建设”工作布局的系统特质和重大关系,在整体谋划和顶层设计中系统把握全面依法治国的目标重点和基础工作。
As an important part of the Four-Pronged Comprehensive Strategy,the comprehensive advancement of law-based governance is a systematic endeavor.Positioning the law-based governance on all fronts as a systematic endeavor highlights the systematic thought in the Marxist theory of the rule of law,inherits the systematic thinking in the fi ne traditional Chinese legal culture,draws on the systematic theory in the benefi cial outcomes of the Western civilization of the rule of law,and carries out the systematic concept of contemporary Chinese Communists.The theory of the systematic endeavor has been used throughout the advancement of the socialist rule of law in China,and is a scientifi c concept and method of thinking that has been tested in practice.Comprehensively advancing law-based governance as a systematic endeavor not only follows the laws that underlie governance by a communist party,but also embodies the laws of advancing the socialist rule of law and is in line with the laws of development of the rule of law civilization of mankind.In the overall system of the Four-Pronged Comprehensive Strategy,the comprehensive advancement of law-based governance serves as a“sub-system”,playing a fundamental and safeguarding role for the other subsystems.The theory of the systematic endeavor provides for a worldview and methodology for comprehensively advancing law-based governance,placing greater emphasis on the systematic concept of the rule of law,the holistic requirements of the rule of law,and the synergistic eff ects of the rule of law.Under the orientation of the systematic endeavor,the comprehensive advancement of law-based governance should always adhere to the centralized and unified leadership of the Communist Party of China,deeply understand the systematic nature and significant relationship between the working layout of“pursuing coordinated progress”and“taking integrated steps”,and systematically grasp the objectives,focuses and foundations of the comprehensive advancement of law-based governance in the context of overall planning and top-level design.
