摘要
夫妻忠诚协议的性质与效力认定不一是实务中同案不同判的根源。该类协议的本质应是夫妻之间签订的身份关系契约,体现身份关系的专属性和自治性的融合,是夫妻之间基于意思自治将法定义务即忠实义务具体化、协议化的契约。在夫妻忠诚协议的效力认定上,需遵循公平、自愿、合法等原则,在不违反法律强制性规定和公序良俗的前提下,该类协议具有法律约束力。应完善夫妻忠诚协议的裁判规则,赋予夫妻忠诚协议的单独可诉性,一旦一方违反,另一方有权以违反夫妻忠诚协议提起诉讼,维护自身合法权益。
The inconsistency in determination of the nature and effectiveness of spousal loyalty agreements is the root cause of different judgments for the same case in practice.The essence of such agreements should be an identity relationship contract signed between spouses,reflecting the integration of the exclusivity and autonomy of the identity relationship.It is a contract between spouses based on autonomy of will,which concretizes and protocolizes the legal obligation,the obligation of loyalty.In determining the effectiveness of spousal loyalty agreements,principles such as fairness,voluntariness,and legality must be followed.Such agreements have legal binding force on the premise of not violating mandatory legal provisions and public order and good customs.It is necessary to improve the judicial rules for spousal loyalty agreements and grant them independent justiciability.Once one party violates the agreement,the other party has the right to file a lawsuit for violating the spousal loyalty agreement and safeguard their legitimate rights and interests.
