摘要
关联性是确立地理标志法益保护的核心要素之一。我国现行地理标志保护制度对于关联性的内涵及具体认定标准均尚未予以规范明确,导致实践中对不同产品的技术要求内容存在差异化评判。以关联性内涵最丰富的加工食品地理标志保护为研究切入点,建议构建基于产品与产地的客观关联性为链接点的专门立法路径,阐明关联性的内涵实质指向产品特异性由产地自然因素和人文因素所决定,进而确立将自然因素和人文因素具象为以土壤、小气候为重点的自然因素加上与该自然因素相匹配的人类技艺为重点的人文因素为载体的基于科学技术衡量的关联性认定标准。
Establishing a strong connection is crucial for protecting geographical indications(GIs).However,China’s existing GI legal framework lacks clarity on what constitutes this connection,leading to inconsistent evaluations of different GI products.This article focuses on processed-food products,which typically have rich ties to their places of origin.It suggests refining the current sui-generis system by emphasizing the objective link between products and their origins.It elucidates that the objective connection refers to the fact that the given quality or characteristics of a product is essentially attributable to both the nature and human factors of a specific origin.Moreover,to establish a credible standard for proving the connection,the natural and human factors shall be translated into elements,involving focuses on natural aspects such as soil and microclimate,as well as human elements like skills that match the natural factors.
