摘要
在全面依法治国战略持续推进与《民法典》实施深化的背景下,如何以民法制度回应国家治理体系和治理能力现代化的要求,成为理论与实务共同关切的重要命题。刘定华教授作为中国较早系统研究民法制度的学者,其学术生涯始终聚焦于财产权、合同法、知识产权、人格权与身份法体系建构等众多关键领域,形成了以“问题导向—制度回应—结构整合”为特征的本土化民法理论体系。纵观刘定华教授在民法领域的系列论著,可从以下四个维度全面反映和揭示他是如何通过理论创新来回应民法中的制度困境与现实张力的:一是以产权结构清晰化推动“良法善治”之财产权制度的重塑;二是以交易实质主义批判形式主义的裁判逻辑,重构市场化的合同治理机制;三是以知识产权私法化路径融入民法统一结构,回应治理一体化与创新发展双重需求;四是以权利结构表达社会结构变迁的制度张力,体现民法回应社会转型的法治精神。刘定华教授的民法思想体现出了鲜明的问题意识、深厚的制度理性与高度的法治精神,其为构建中国特色的民法学科体系和推动法治中国建设提供了重要理论资源与制度启示。
Against the backdrop of the ongoing strategies of comprehensively governing the country by law and the deepening implementation of the Civil Code,how civil law institutions can respond to the requirements of modernizing the national governance system and governance capabilities has become a critical issue of shared concern in both theory and practice.As one of China’s early scholars to systematically study civil law institutions,Professor Liu Dinghua has dedicated his academic career to the key areas such as property rights systems,contract law theory,intellectual property ownership,and the construction of personality rights and family law systems,forming a localized civil law theoretical system characterized by problem orientation,institutional response,and structural integration.A comprehensive review of Professor Liu Dinghua’s series of works in civil law reveals how he addressed institutional dilemmas and practical tensions through theoretical innovation across four dimensions:first,reshaping the property rights system to promote sound laws and good governance by clarifying property structures;second,critiquing formalistic adjudication logic through substantive transaction principles to reconstruct a market-oriented contractual governance mechanism;third,integrating intellectual property into the unified civil law structure via a private law approach,addressing both governance coherence and innovation-driven development;and fourth,expressing the institutional tensions of social structural changes through rights frameworks,embodying civil law’s responsiveness to social transformation and the spirit of rule of law.Evidently,Professor Liu Dinghua’s civil law thoughts demonstrate a distinct problem awareness,profound institutional rationality,and a strong commitment to the rule of law,providing important theoretical resources and institutional insights for constructing a civil law discipline with Chinese characteristics and promoting the construction of the rule of law in China.
