摘要
正当防卫的适用需要具备前提条件、主观条件、时间条件、对象条件和限度条件。以正当防卫理论为基础,结合《刑法》第二十条及《指导意见》,分析校园霸凌中正当防卫的适用问题,包括“不法侵害”认定模糊、防卫强度失控、与挑唆防卫混淆等。研究指出,需明确霸凌行为的违法本质,区分正当防卫与过度防卫的界限,并提出针对性对策:通过精准界定防卫行为、合理控制防卫强度、强化证据收集与法律援助、完善校园安全管理体系,构建“法律规制—教育干预—心理疏导”三维治理模型。破解校园霸凌需突破单一法律视角,融合教育引导与心理支持,以实现未成年人权益的双向保护。
The application of justifiable defense requires preconditions,subjective conditions,temporal conditions,target conditions,and limitation conditions.Grounded in justifiable defense theory and in conjunction with Article 20 of the Criminal Law and the Guiding Opinions on justifiable defense,this study examines the application challenges in campus bullying,including ambiguous identification of“illegal infringement”,uncontrolled defensive intensity,and confusion with provoked defense.The research proposes that clarifying the illegal nature of bullying behaviors and demarcating the boundary between justifiable defense and excessive defense are essential.Targeted solutions include precise definition of defensive acts,reasonable control of defensive intensity,enhanced evidence collection and legal assistance,improved campus safety management systems,and establishment of a tripartite governance model integrating legal regulation,educational intervention,and psychological counseling.Cracking down on campus bullying requires breaking through a single legal perspective,integrating educational guidance and psychological support to achieve dual protection of minors’rights and interests.
