摘要
人工智能生成内容的可版权性和版权归属目前是版权领域具有争议的话题,关乎未来人工智能技术进步和产业发展趋势。人工智能大模型生成内容在形式上与人类的作品近乎无异,但在内容上差别较大,原因在于人工智能虽然模拟人类的思维,但并不具备人的思想情感,不具有创作意图。通过著作权制度的回溯和理念重塑,能够明确著作权制度人本主义的价值理念和独创性标准,依据人类的“贡献程度”可以对人工智能生成内容的可版权性进行分类,使其版权问题进一步明晰。
The copyrightability and ownership of content generated by artificial intelligence(Al)are currently contentious issues in the field of copyright,which are crucial to the future progress of Al technology and industrial development trends.The content generated by large AI models is almost identical in form to human-created works,but differs significantly in content.This difference arises because,although Al simulates human thinking,it lacks human thoughts and emotions,and does not possess creative intent.By reviewing the history and reshaping the concepts of the copyright system,the human-centered value philosophy and the standard of originality in copyright can be clarified.Based on the"degree of human contribution",the copyrightability of Al-generated content can be categorized,thereby further clarifying its copyright issues.
