摘要
在数字化时代,网络证据在专利授权、确权环节的应用愈发广泛,然而其无实体载体的特性,致使公开性认定成为专利审查中的关键难题。文章聚焦专利审查领域,深入探讨了高度盖然性标准在网络证据公开性认定实践中的应用,系统剖析了网络证据举证责任分配规则。经过对复审无效典型案例的细致分析,文章从发布者、发布内容、发布平台以及多视角融合分析等四个维度,详细阐释了网络证据分享与推广意图的认定要点,并基于此构建了基于高度盖然性的网络证据公开性认定体系,为提高专利授权、确权工作的准确性与可靠性提供科学有效的方法支撑,推动完善专利审查中网络证据认定的理论与实践。
In the digital era,online evidence is extensively applied in patent authorization and confirmation.However,its non-physical carriers make public recognition a key challenge.In view of this,the article explores the application of high degree of probability in the public recognition of online evidence,and analyzes the rules for allocating the burden of proof.Through a detailed analysis of typical cases of invalid reexamination,this article elaborates on the key points of determining the intention of sharing and promoting network evidence from four dimensions:publishing subject,publishing content,publishing platform,and multi-dimensional fusion.Based on this,a system based on high degree of probability is constructed,which provides scientific and effective methodologies for enhancing the accuracy and reliability of patent authorization and confirmation,and helping to improve the theory and practice of network evidence recognition.
