摘要
我国数字经济快速发展同时带来的安全风险加剧,亟需有效的法律保障。数字经济安全法律供给系统的正常运转是数字经济健康发展的前提与基础。本文构建数字经济安全法律供给的均衡性三维分析框架,基于国家层面的64份数字经济安全法律文本,运用社会网络分析和内容分析,分析了数字经济安全法律供给的三阶段动态演进过程,揭示了该供给系统的不均衡和协同性特征。研究发现,数字经济安全法律供给体系是一个矛盾驱动的复杂系统,在法律工具、法律主体和法律强度的协同作用下促进了法律的均衡与合力,但该体系仍存在数量与质量的不平衡。需通过强化环境型、需求型和供给型工具的协同配合,推动法律供给系统深层次演进。
As China’s digital economy rapidly develops,it simultaneously intensifies security risks,urgently necessitating effective legal protections.The normal operation of the digital economy’s legal supply system is a prerequisite and foundation for its healthy development.This paper constructs a three-dimensional analysis framework for the balanced supply of digital economy security laws.Based on 64 legal texts related to digital economy security at the national level,using social network analysis and content analysis,this study analyzes the three-stage dynamic evolution process of digital economy security law supply and reveals the imbalance and synergy characteristics of this supply system.The research finds that the digital economy security law supply system is a contradiction-driven complex system.The synergy of legal tools,legal entities,and legal intensity has promoted the equilibrium and concerted efforts of laws,although the system still shows imbalances in quantity and quality.By strengthening the collaborative coordination of environmental,demand-oriented,and supply-oriented tools,the legal supply system is expected to evolve to higher levels.
