摘要
我国现行的侦企合作模式暴露出数据安全体系薄弱、合作机制缺乏规范性以及侦查机关主导性不足等问题。为提高侦企合作效率,在理论层面,可以基于第三方警务理论确定侦企合作的四维框架——明确合作目标、界定第三方主体、规范“法律杠杆”的应用及强化企业责任。在实践层面,应贯彻落实2024年全国刑事侦查工作会议精神,在“专业+机制+大数据”新型警务模式运行框架下整合资源,破解数据疏于保护、技术过度依赖与专业人才短缺三大壁垒,构建侦查机关主导、企业深度融入的侦查中心。
The current cooperation model between investigative agencies and enterprises in China has exposed such problems as weak data security systems,lack of standardization in cooperation mechanisms,and insufficient leadership of investigative agencies.To improve the efficiency of cooperation between law enforcement agencies and enterprises,a four-dimensional framework for cooperation can be established based on third-party policing theory:clarifying cooperation goals,defining third-party entities,regulating the application of"legal leverage",and strengthening corporate responsibility.At the practical level,the spirit of the 2024 National Criminal Investigation Work Conference should be implemented,integrate resources within the framework of the new policing model of combining professional with mechanism and big data,break through the three major barriers of data neglect,excessive dependence on technology,and shortage of professional talents,and build an investigation center led by investigative agencies and deeply integrated into enterprises.
