摘要
当前,理论界对命案积案核准追诉报请程序缺乏深入系统的考量,实务界也面临权威解释与指导性案例不足而缺少统一司法尺度的困境。命案积案核准追诉报请程序司法实践适用中存在的问题主要是:追诉必要性的认定标准和具体条件较为混乱;关于“立案”“应当立案”“立案侦查”的内涵未达成统一观点;报请中逮捕前置造成程序异化;审查期限混乱等。其根源在于例外条款的虚置、不合理捕诉考核指标制度的绑架、刑事错案国家赔偿机制存在缺陷等。突破命案积案核准追诉报请程序困境的革新措施应包括:结合案发时代背景适度降低现存“立案”标准,“以事立案”应与“以人立案”同属于“立案侦查”的范畴,并对其设置更高的事实标准;从根源上修改国家赔偿法相关规定与不合理捕诉考核指标,优化监视居住的适用,将其实质化为逮捕的替代性措施;回归并重置报请程序办案期限的规定;加强公安机关与检察机关的协作以及各级检察机关之间的协作,落实实质性审查的要求。
At present,the theoretical circle lacks in-depth and systematic consideration of the procedures for the approval and prosecution of backlogged homicide cases,and the practical circle also faces the dilemma of insufficient authoritative interpretation and guiding cases and lack of unified judicial standards.The main problems in judicial practice are:the criteria and specific conditions for determining the necessity of prosecution are confused;No unified views have been reached on the connotation of“case-filing”“case-should-be-filed”and“investigation filing”.The procedure dissimilation resulted from the arrest in advance of the application.The root cause lies in the absence of exception clause;According to the background of the time of the crime,the existing standards should belong to the same category and set a higher standard of facts.Revise the relevant provisions of the State Compensation Law,optimize the cooperation between public security at all levels and implement the requirements of substantive review.
