摘要
我国《著作权法》第四十五条规定的传播录音制品获酬权在性质上是一种区别于专有权的单纯获酬权,因其并不具有禁止他人传播录音制品的法律效力,个体行权面临着极高的成本问题,因而应当采取由著作权集体管理组织集中行权的模式。在集中行权模式下,集体管理组织依法取得了对传播录音制品获酬权的强制管理资格,此举对获酬权人的行权意志自由构成限制,却是节约制度运行成本、规范行权秩序的现实选择。我国当前的著作权集体管理制度与传播录音制品获酬权的集中行权要求仍不匹配,有待立法完善。就适用范围而言,尽管我国在加入《世界知识产权组织表演和录音制品条约》时对第十五条有关录音制品获酬权的条款声明保留,但在《著作权法》业已通过修改对传播录音制品获酬权作出规定的情形下,我国仍有义务按照《世界知识产权组织表演和录音制品条约》第四条的规定,对符合要求的其他缔约方的录音制作者给予国民待遇。
The remuneration right for the dissemination of sound recordings as stipulated in Article 45 of China’s Copyright Law is,in nature,a kind of pure right to remuneration which is different from the exclusive right,and since it does not have the legal effect of prohibiting others from disseminating sound recordings,individual enforcement of the right is faced with the problem of extremely high costs,and therefore the mode of centralized enforcement of the right should be adopted by the collective management organizations of copyright.Under the centralized enforcement model,collective management organizations are legally qualified to enforce the right to receive remuneration for the dissemination of sound recordings,which constitutes a restriction on the freedom of will of the right holders to enforce their rights,but it is a realistic choice to save the costs of the system’s operation and regulate the order of enforcement of rights.China’s current copyright collective management system still does not match the centralized enforcement of the right to receive remuneration for the dissemination of sound recordings,and legislation needs to be improved.Although China declared a reservation to article 15 on the remuneration right for sound recordings when it acceded to the WIPO Performances and Phonograms Treaty,it is still obliged to give national treatment to producers of sound recordings from other parties who meet the requirements,in accordance with the provisions of article 4 of the Treaty,in the event that the remuneration right for the dissemination of sound recordings is provided for in the amendments to the Copyright Law.
