数智时代公共图书馆合理使用的困境与因应

Challenges and Responses to Fair Use of Public Libraries in the Digital Intelligence Era

摘要 我国现行法上公共图书馆合理使用规定存在局限性,具体表现为场所限制难以回应数字化阅读需求、从“借阅”到“传播”的扩张缺乏合理化论证、三重约束导致图书馆在线提供作品范围大幅受限,以及使用目的制约新型图书馆功能拓展与发挥。数智时代,为实现缩小数字鸿沟、保障信息公平、促进社会正义等功能,建议规定宽泛的图书馆合理使用条款,允许图书馆为保障公民基本文化权益的需要,在合理范围内使用已经发表的作品。具体建议方面,应明确图书馆从事文本与数据挖掘行为的合法性,允许图书馆提供区别于信网传输的“受控线上借阅”服务,规定无过错的图书馆继续使用已持有数字作品的豁免条款,以弥合阅读鸿沟、提升阅读普惠性。 The current provisions on the fair use of public libraries in China’s legal system exhibit certain limitations.Specifically,the restrictions on physical locations struggle to meet the demands of digital reading,the expansion from“borrowing”to“dissemination”lacks rational justification,triple constraints significantly limit the scope of works that libraries can provide online,and the constraints on purposes of usage hinder the development and utilization of new library functions.In the era of digital intelligence,establishing broad fair use provisions for libraries is essential,in order to support the reduction of the digital divide,ensure information equity,and promote social justice.Such provisions should allow libraries to use published works within reasonable limits to safeguard citizens’fundamental cultural rights.Specific suggestions include clarifying the legality of libraries engaging in text and data mining,permitting libraries to offer“controlled online lending”services distinct from network transmission,and providing exemption clauses for libraries to continue using digital works they already possess with bona-fide intention,thereby bridging the reading gap and enhancing reading inclusivity.
