摘要
《商君书》作为一部法家经典,历史上对其争论不一,但无法掩盖其中诸多正面的法治思想。本文归纳书中的法家“法治”思想体系(涵盖“法家哲学”“法律主体”“法治措施”),将视角、突显、详略度等三类认知识解维度融入其现存两类英译本,即荷兰汉学家戴闻达和以色列汉学家尤锐(下称戴译和尤译),进而探赜法家“法治”思想的重构效果。研究发现,两类译文就“法治”的识解差异性表现为:戴译强调法家历史观,其翻译识解偏客观,对应原文思想的公正性和执行性;尤译重视法家政治观,其翻译识解重互动,契合书中思想的顺应性与合理性。
As a legalist classic,The Book of Lord Shang boasts plentiful positive thoughts on the rule of law,despite controversies in history.Through summarizing legalist thoughts on the“rule of law”from the book(including“Legalist philosophy”,“legal subjects”,and“rule-of-law measures”),this paper integrates three dimensions of cognitive construal:perspective,prominence,and specificity into its two existing English versions by Dutch sinologist J.J.L.Duyvendak and Israeli sinologist Yuri Pines,so as to assess reconstruction of these thoughts.In conclusion,construal discrepancies in expressions related to the“rule of law”are found as follows:first,Duyvendak underlines Legalist views on history that make his translation construal more objective,thus corresponding to thoughts of impartiality and enforceability;second,Yuri Pines emphasizes legalist views on politics which render his translation construal more interactive,hence agreeing with thoughts of adaptability and rationality.
