摘要
以整体性思维来全面剖析与解读中国式环境法治现代化这一话语体系的本体论逻辑,首要的是准确把握中国式环境法治现代化概念的内在逻辑,形成对“环境法治现代化”“法治现代化”以及“中国式现代化”这三个概念范畴相互关系的清晰理解,详细阐明整体性思维之于中国式环境法治现代化所具有的内在契合性。中国式环境法治现代化的目的论逻辑指的是新时代环境法治建设在多个维度上的系统升级,包括独立自主型环境法学知识体系的建构、环境法治思维的空间转向、环境法治理念的系统革新三个方面。应以整体性思维为支撑,不断推进环境法治规范体系的完善、环境法治实施体系的系统嬗变、环境法治保障体系的健全,为中国式环境法治现代化目标的实现建立起多维拓展的系统性方案。
To comprehensively analyze and interpret the ontological logic of the discourse system of Chinese modernization of environmental rule of law with holistic thinking,the first thing is to accurately grasp the internal logic of the concept of Chinese modernization of environmental rule of law,form a clear understanding of the relationship between the three concept categories of“modernization of environmental rule of law”,“moderniza-tion of rule of law”and“Chinese modernization”,and elaborate the internal fit of holistic thinking to Chinese modernization of environmental rule of law.The teleological logic of the Chinese modernization of environmental rule of law refers to the systematic upgrading of environmental rule of law construction in multiple dimensions in the new era,including the construction of an independent and autonomous environmental legal knowl-edge system,the spatial shift of environmental rule of law thinking,and the systematic innovation of environmental rule of law concepts.We should be supported by holistic thinking,continuously promote the improvement of the environmental legal regulatory system,the systematic transformation of the environmental legal implementation system,and the soundness of the environmental legal guarantee system,in order to establish a multidimensional and systematic plan for the realization of the Chinese modernization of environmental rule of law.
