The Types and Generative Logics of Co-Regulation between the Government and Platform Enterprises in the Platform Economy——A Multi-Case Study Based on the Online Transaction Regulation in City A

摘要面对平台经济的监管挑战,政府与平台企业的合作监管成为平台监管中的重要模式。随着合作监管实践不断涌现,如何类型化和解释不同的合作监管成为随之而来的问题。本文通过参与式观察、深度访谈等方法,对A市网络交易监管中的四个合作监管案例进行研究。基于对案例的分析,本文总结构建了“监管情境-联结机制-合作类型”的理论分析框架,以解释平台经济监管中不同政企合作监管类型的生成逻辑。研究发现,面对由监管清晰程度和资源依赖程度构成的差异化监管情境,监管部门会选择不同的联结机制,与平台企业在监管规则制定和执行两个环节上达成不同的合作关系,最终形成协助型、赋权型、协商型和指导型四种合作监管类型。本文在案例研究的基础上,与西方合作监管理论对话,对理解中国场景下的平台经济合作监管具有一定意义,对监管部门与平台企业的合作策略选择具有参考意义。 Facing the regulatory challenges of the platform economy,co-regulation between the government and platform enterprises has become an important approach in platform regulation.With the continuous emergence of co-regulation practices,how to categorize and explain different types of co-regulation has become an interesting issue.Through participatory observation and in-depth interviews,this paper examines four cases of coregulation in the field of online transaction regulation in City A.This paper summarizes and builds a theoretical analysis framework of“regulation context,connection mechanism,and cooperative type”to explain the generative logics of different types of government-enterprise co-regulation in platform governance.The study finds that government,when faced with varying regulatory contexts defined by the clarity of regulatory mandates and the degree of resource dependence,adopt different connection mechanisms and establish distinct cooperative relationships with platform enterprises in the regulatory rule-making and enforcement.As a result,four types of co-regulation emerge:assisted co-regulation,empowered co-regulation,negotiated co-regualtion and directive co-regualtion.In conclusion,this study engages with Western theories of co-regulation and contributes to a deeper understanding of platform regulation in the Chinese context,offering valuable insights for regulatory authorities in selecting appropriate strategies for cooperation with platform companies.
