摘要
在环境刑事案件办理中,涉案污染物性质鉴定作为主要的专门性问题成为定罪量刑的重要依据。本文基于目前的法条、文件以及污染物性质鉴定技术体系,总结了国内环境刑事案件中涉及比较多的危险废物、有毒物质以及有害物质的鉴定依据。结合司法鉴定实践中的典型案例,归纳了涉案污染物性质鉴定的常用思路及方法,为环境损害司法鉴定从业者提供参考,为科学合理地构建涉案污染物性质鉴定技术体系以及环境监管和治理提供科学依据。
The accurate identification of pollutants is a critical factor in handling environmental criminal cases,serving as a fundamental basis for conviction and sentencing.This paper presents an overview of the legal framework,documentation,and technical systems related to identifying hazardous wastes,toxic substances,and harmful materials in domestic environmental criminal cases.Through the analysis of typical case studies,it delineates common principles and methods for determining pollutant nature to provide guidance to practitioners involved in judicial assessment of environmental damage.Additionally,it aims to establish a scientific and rational technical standard system for pollutant nature identification to ensure judicial fairness.
