摘要
近年来,太空技术试验引起了国际社会的广泛关注,也引发了各国就国际空间法规则运用的博弈和较量。从国际法层面分析太空技术试验引发的若干问题,阐述了国际空间法的发展现状及对规制太空技术试验的局限性。在此基础上,探讨分析了对他国航天器和本国航天器进行试验的两类情况,厘清了进行太空技术试验的合法性问题,并指出开展太空技术试验需要承担的国际通报义务和损害赔偿义务等。
In recent years,the space technology test has aroused widespread concern of the international community,prompting,debates and competitions among nations over the applications of international space law.This paper analyzes from the level of international law several problems caused by the space technology test,and expounds the development status of international space law and the limitations of regulating space technology test.On this basis,this paper discusses the two types of tests for other national spacecraft and domestic spacecraft,clarifies the legality of the space technology test,and points out that the space technology test should undertake the obligation of international notification and compensation for damages.
