摘要
婴幼儿普惠托育服务的法治保障是构建高质量托幼体系的重要路径。以法治保障婴幼儿普惠托育服务的发展具备必要性、可行性、可持续性的理论基础。当前法治保障面临着法律制度供给宏观化、政府定位和法律关系不明晰、普惠托育服务标准不明确、政府监管机制不健全等困境。围绕以“基本法+配套规定”为路径优化法律制度顶层供给、以“普惠”为核心明确婴幼儿托育服务属性和标准、以“可行性”为标准鼓励发展婴幼儿普惠托育服务、以“责任”为原则强化政府定位和多元供给的法律治理、以“人民”为中心健全动态化监督机制等五个方面,构建多元供给婴幼儿普惠托育服务发展的法治保障体系。
The legal guarantee of universal childcare services for infants and young children is an important path to building a high-quality childcare system.The theoretical basis for ensuring the development through the rule of law is necessary,feasible,and sustainable.The current guarantee of the rule of law is facing challenges such as the macro level supply of the legal system,unclear government positioning and legal relationships,unclear standards for inclusive childcare services,and inadequate government regulatory mechanisms.By optimizing the top-level supply of the legal system through the path of“Basic Law+Supporting Regulations”,clarifying the attributes and standards of infant and toddler care services with“universal access”as the core,encouraging the development of infant and toddler care services with“feasibility”as the standard,strengthening the government’s positioning and legal governance of diversified supply based on the principle of“responsibility”,and improving the dynamic supervision mechanism centered on the“people”,we aim to establish a legal guarantee system for the development of inclusive childcare services for infants and young children with diversified supply.
