摘要
海河流域作为京津冀协同发展和雄安新区建设的核心区域,其水灾害防御、水资源保护、水生态修复和水环境治理对于区域乃至全国的可持续发展具有重要意义。基于党的二十大提出“全面依法治国”“在法治轨道上全面建设社会主义现代化国家”的部署,系统分析海河流域管理的现状与问题,论证流域综合立法的必要性与可行性,并提出了以生态优先、系统治理为核心的制度体系框架。研究表明,现行法律法规存在协调性不足、操作性弱等缺陷,亟需通过流域立法填补制度空白,强化跨区域协同,推动水资源刚性约束与生态保护。研究成果为海河流域法治化治理提供了理论依据与实践路径。
As the core area for the coordinated development of Beijing-Tianjin-Hebei and the construction of Xiong′an New Area,the Haihe River Basin plays an important role in water disaster prevention,water resource protection,water ecological restoration,and water environment governance for the sustainable development of the region and even the whole country.This article is based on the deployment of"comprehensively implement the rule of law"and"comprehensively building a socialist modernized country on the track of rule of law"proposed at the 20th National Congress of the Communist Party of China.It systematically analyzes the current situation and problems of management in the Haihe River Basin,demonstrates the necessity and feasibility of comprehensive legislation in the basin,and proposes an institutional framework with ecological priority and systematic governance as the core.Research has shown that current laws and regulations have deficiencies such as insufficient coordination and weak operability.It is urgent to fill institutional gaps through watershed legislation,strengthen cross regional collaboration,and promote rigid constraints on water resources and ecological protection.This article provides both theoretical foundations and practical path for the rule of law governance in the Haihe River Basin.
