摘要
对未成年人的父母或其他监护人签发家庭教育指导令,是人民法院基于国家亲权原则,依法对因家庭监护失职而权益受损害的未成年人所实施的特殊保护。制发家庭教育指导令,是国家将公权力延伸至家庭自治私领域的重要手段。只有在符合适用要件的情形下,人民法院才可以采用职权主义与当事人主义制发家庭教育指导令。家庭教育指导令应当包含责令理由、适用对象、实施举措、法律后果、程序救济等应然内容。有效执行家庭教育指导令,是矫治不良家庭教育行为,开展未成年人权益保障与犯罪预防的关键环节。这需要人民法院综合施策,建立诸多配套措施。
The issuance of family education guidance orders to the parents or other guardians based on law is a special protection implemented by the peoples court according to principle of parens patriae for juveniles whose rights and interests are damaged due to negligence of family guardianship.The issuance of family education guidance orders is an important means for the state to extend public power to the private domain of family autonomy.Only in cases where the applicable requirements are met,the court can formulate and issue family education guidance orders by inquisitorial system and adversarial system.The family education guidance order should include necessary content such as reasons for ordering,applicable objects,implementation measures,legal consequences,procedural remedies,etc.Effective implementation of family education guidance order is a key link to correct bad family education behavior,and to achieve the protection of juveniles’rights and crime prevention.This requires the peoples court to take a comprehensive policy and establish many supporting measures.
