摘要
教育强国建设的核心在于构建高质量的教育治理体系,而高质量教育治理体系的基础是高质量的教育法律体系。完善的教育法律体系有助于夯实教育强国的法治基础,稳定教育强国的制度预期,支撑教育强国的持续建设。教育强国建设背景下,教育法律体系建设需回应教育法在国家法律体系中的定位问题,满足教育改革与发展中的立法需求,协调教育法律规范间的配套与衔接,完善教育法律体系的调整机制等具体诉求。为此,应明确教育法律体系完善的指向与框架,把握教育法在法律体系中的独特地位;填补当前教育领域的立法缺失,回应教育改革与发展的现实需求;优化教育法律规范间的配套与衔接,增进教育法律体系的系统性与协调性;健全动态的修法与释法机制,增强教育法律的前瞻性与适用性。
The core of building a powerful country of education lies in constructing a high⁃quality education governance system,and the foundation of a high⁃quality education governance system is a high⁃quality educational legal system.A perfect educational legal system helps to consolidate the le⁃gal foundation of an education⁃empowered country,stabilize the institutional expectations of a powerful education country,and support the continuous construction of a powerful education country.Under the background of the strategy for building a powerful education country,the construction of the edu⁃cation legal system needs to respond to the positioning of education law within the national legal sys⁃tem,meet the legislative needs in education reform and development,coordinate the matching and connection between education legal norms,and improve the adjustment mechanism of the education legal system and other specific demands.We should clarify the direction and framework for improv⁃ing the education legal system and grasp the unique position of education law within the legal sys⁃tem;fill the legislative gaps in the current education field and respond to the actual needs of educa⁃tion reform and development;optimize the matching and connection between education legal norms and enhance the systematization and coordination of the education legal system;improve the dynam⁃ic mechanism for amending and interpreting laws and enhance the foresight and applicability of edu⁃cation laws.
