摘要
非法集资刑事案件涉案财物处置存在着集资参与人数不定、财产查清追缴困难、刑民交叉程序复杂等特殊难题,导致司法实践中面临如公诉机关处置意见不明、庭审环节缺乏实质审理、裁判文书相关表述混乱等诸多问题。目前,法律规定与学界讨论中对此存在采用行政管理、刑事诉讼及商法清算处置模式的争议,但模式各有利弊,无万全之策。应在刑事诉讼主导下,综合各模式优势,根据案件复杂度分流选择。简单案件可修正现有机制,加强控方举证责任,并优化裁判文书表述。对复杂案件则应通过专业化合议庭、独立庭审程序、社会资源调动及电子平台支持等手段进行制度升级,优化司法资源配置。
The disposal of property involved in criminal cases of illegal fundraising faces unique challenges,including an uncertain number of participants,difficulties in identifying and recovering assets,and the complexity of procedures involving both criminal and civil law.These challenges result in various issues in judicial practice,such as ambiguous disposal opinions from prosecutors,insufficient substantive examination during trials,and inconsistent or unclear language in court rulings.Currently,legal provisions and academic discussions debate the adoption of administrative management,criminal proceedings,and commercial law liquidation models for disposal.However,each model has its strengths and weaknesses,and there is no universal solution.Guided by criminal proceedings,it is recommended to integrate the strengths of different models and adopt a differentiated approach based on the complexity of the case.For simple cases,the existing mechanisms can be improved by enhancing the prosecution’s burden of proof and refining the language used in court rulings.For complex cases,institutional improvements should be implemented through specialized collegiate panels,independent trial procedures,mobilization of social resources,and the use of electronic platforms,thereby optimizing the allocation of judicial resources.
