摘要
2024年8月1日,《公平竞争审查条例》(以下简称《条例》)正式生效。《条例》尚未解决例外规定的高度抽象性问题,这一现状有可能致使例外制度因理解困难与实践操作性低而趋于“形同虚设”,或因解释空间宽泛而易被“过度利用”,削弱例外制度的实际运行效果。鉴于此,有必要在竞争中性原则的视角下衡量例外制度内在价值,将维护社会公共秩序作为例外制度价值衡量的原则要求,吸收比例原则作为例外规定的个案判断标准。同时,从现有例外制度框架出发,明确现有规范中蕴含的例外制度内涵、实体性要件和程序性要件,为制度的优化提供可能路径,推进公平竞争审查例外制度实施。
nature of the exception provisions.The situation may lead to the exception system becoming"virtually non-existent"due to difficulties in understanding and low practical operability,or being"overused"due to broad interpretative space,thereby weakening the actual effectiveness of the exception system.In light of this,it is necessary to measure the intrinsic value of the exception system from the perspective of the principle of competitive neutrality,taking the maintenance of social public order as the principle requirement for value measurement of the exception system,and absorbing the principle of proportionality as the case-by-case judgment standard for exception provisions.At the same time,starting from the existing framework of the exception system,it is necessary to clarify the connotation of the exception system,substantive requirements,and procedural requirements contained in the existing norms,providing possible paths for the optimization of the system and promoting the implementation of the exception system for fair competition review.
