摘要
习近平法治思想是马克思主义法学理论中国化的最新成果,不仅体现了马克思主义理论的人民性,还受到中华传统民本思想的影响,是新时代中国共产党人在法治领域坚持“两个结合”的理论成果。朱子从天理的高度,阐释传统民本思想,使传统民本思想有了本体论依据。习近平法治思想继承朱子维护人民利益、追求公平正义、教化民众等民本思想精髓,并在新的历史背景下,创造性转化和创新性发展了朱子民本思想,主要体现在实践方略由依赖明君到法律制度保障、根本目的由维护君权到人民当家作主、人的历史地位由“中介”到“主体”。
President Xi Jinping Thought on the Rule of Law is the latest achievement of the sinicization of Marxist legal theory,which not only reflects the people’s nature of Marxist theory,but is also influenced by traditional Chinese folk-oriented thought,and is the theoretical achievement of the Communist Party of China(CPC)of adhering to the“two combinations”in the field of the rule of law in the new era.Zhu Zi explained the traditional people-oriented thought from the height of the heavenly principle,so that the traditional people-oriented thought has an ontological basis.Xi Jinping Thought on the Rule of Law has inherited the essence of Zhu Zi’s people-oriented thoughts on safeguarding the interests of the people,pursuing fairness and justice,and educating the people,and has creatively transformed and innovatively developed Zhu Zi’s people-oriented thoughts in the new historical context,which is mainly embodied in the practical strategy of relying on the ruler to the protection of the legal system,the fundamental objective of safeguarding the power of the ruler to the people’s sovereignty,and the historical status of the human being from an intermediary to a subject.
