摘要
“亲亲相隐”的形成发展经历了从义务本位到权利本位、从思想到原则再到制度、从“子为父隐”到“父子相隐”“亲亲相隐”再到“同居相为隐”的一系列转变。从法理视角分析“亲亲相隐”,法理蕴含:道理上,其源于天道的人性伦理;事理上,其满足统治阶层维护国家和社会秩序稳定的治理需求;义理上,其与儒家思想的发展密切相关;情理上,其属于孝亲观念在法律上的贯彻。目前我国相关法律仍有待完善之处,应在结合古代立法经验基础上,立足我国国情,加快完善立法,避免当事人陷入亲情义务与法律义务之间二选一的两难境地。
The formation and development of“Relatives'Mutual Concealment”has undergone a series of transformations,from an obligation-based to a rights-based approach,from ideology to principle and then to system,and from“a child concealing for a parent”to“parents and children concealing for each other”,to“relatives concealing for each other”,and finally to“household members concealing for each other”.From a legal perspective,the concept of"concealing for relatives"logically originates from the human ethics of the natural order;practically,it meets the ruling class's need to maintain national and social order and stability;philosophically,it is closely related to the development of Confucianism;emotionally,it represents the implementation of the concept of filial piety in law.Currently,our relevant laws still need improvement.We should accelerate the perfection of legislation based on ancient legislative experience and national conditions of our country to avoid putting parties in a dilemma of between familial obligations and legal duties.
