摘要
关于通谋虚伪表示成立后,合同一方企图妨害司法秩序、损害他人权益,利用诉讼隐涉及合同效力重要事实的行为定性,关键是对隐螨行为进行虚假诉讼罪不纯正不作为犯及其法益的涵摄探究。对无效隐藏合同、无效虚伪合同进行真实效力隐瞒与歪曲的行为,具有超出民法调整范围而应予刑事规制的可能性,应当以隐瞒型虚假诉讼罪的行为本体即不纯正不作为犯的等价性,以及“综合法益说”的法益构造为理论前提,通过被隐瞒事实的关键性、履行告知义务的必要性与主观可谴责性的审查机制,厘清行为犯罪与否的认定思路与规则,并以此深化虚假诉讼罪本质的研究。
After the establishment of the representation of collusive hypocrisy,the key to the characterization of the behavior of one party to the contract who attempts to disrupt the judicial order and damage the rights and interests of others by concealing the important facts related to the validity of the contract through litigation is the investigation of the crime of false litigation,the crime of non-pure omission and the implication of its legal interests.The act of concealing and distorting the real effect of invalid hidden contract or invalid false contract has the possibility that beyonds the scope of civil law adjustment and should be under the criminal regulation.In this regard,we should take the equivalence of the behavior ontology of the false litigation crime of concealment,that is the impure omission crime,and the legal interest structure of the"comprehensive legal interest theory"as the theoretical premise,through the key of the concealed facts,the necessity of fulfilling the obligation of notification and the subjective reprehensibility of the review mechanism,clarify the thoughts and rules of identifying whether the behavior is criminal or not,and deepen the research on the essence of the false litigation crime.
