摘要
民营经济公平竞争是市场经济得以充分发展的前提条件,关键在于是否能为民营企业提供有效的公平竞争法治保障。目前我国保障民营经济公平竞争的法律制度并不健全,在顶层设计和具体规则方面均有所欠缺。因此,有必要通过比照营商环境法治化的要求和标准,厘清民营经济公平竞争制度的评估因素。在此基础之上,既要明确我国竞争政策的基本原则,为民营经济公平竞争的制度建设提供指引,又要从立法、执法和司法层面进一步细化民营经济公平竞争的具体规则,以期最大程度地促进民营经济的良好发展。
Fair competition of private sector economy is a prerequisite for the full development of market economy.The key lies in whether it provides effective rule of law protection for fair competition of private enterprises.At present,China's legal system to ensure fair competition in the private sector economy is still in need of improvement,and there are deficiencies in the top-level design and specific rules.Therefore,it is necessary to clarify the evaluation factors of the fair competition system in the private sector economy by comparing the requirements and standards of building a law-based business environment.On this basis,we should make clear that the basic principle of our competition policy provides basic guidance for the system construction of fair competition in the private sector economy.It is also necessary to further refine the specific rules governing fair competition in the private sector economy from the level of legislation,law enforcement and justice,in order to promote the sound development of the private sector economy to the greatest extent.
