摘要
在贸易全球化的背景下,跨境药品犯罪不断增加,成为国际社会面临的严峻问题。跨境药品犯罪中,“未经批准进口的药品”认定的复杂性和困难性源于多方面原因。其中,司法适用缺位、域外取证程序繁琐、行政监管制度不足以及检验方法模糊等问题成为制约因素。为解决这一难题,需厘清药品犯罪司法适用,明确法规适用范围,填补法律缺陷;推动药品法律域外适用,加强国际协作,形成全球联防体系;优化行刑衔接协作机制,建立多部门协同作战体系,提高案件侦办效率。在质检与鉴定方面,构建双轨制度,使其更具针对性和准确性。此外,推进注册信息的国际接轨,加强跨境药品信息追溯,降低跨境药品犯罪风险。
In the context of global trade,cross-border drug crimes continue to increase,becoming a serious problem facing the international community.The complexity and difficulty of identifying“unapproved imported drugs”in cross-border drug crimes stem from various reasons.Among them,the lack of judicial application,cumbersome procedures for obtaining evidence outside the jurisdiction,insufficient administrative supervision system,and vague testing methods have become constraining factors.To solve this problem,it is necessary to clarify the judicial application of drug crimes,clarify the scope of regulatory application,and fill legal gaps;Promote the extraterritorial application of drug laws,strengthen international cooperation,and form a global joint defense system;Optimize the execution coordination mechanism,establish a multi-sectoral collaborative combat system,and improve the efficiency of case investigation.In terms of quality inspection and identification,establish a dual track system to make it more targeted and accurate.In addition,we will promote international standardization of registration information,strengthen cross-border drug information tracing,and reduce the risk of cross-border drug crimes.
