摘要
中国式行政法治现代化有着特色鲜明的开辟、推进和拓展历程。改革开放以来,中国式行政法治现代化鲜明地呈现出以市场经济建设为逻辑起点,以法治观念嬗替为思想先声,以行政法制建设为制度基石和以行政审判实践为内在驱动的接力推进样态。经济体制改革呼唤政府治理革命,法治精神启蒙引导依法行政实践,高度集中管制转向常态行政管理,行政诉讼法治倒逼行政实体法治,由此递进而生、汇聚而成的改革开放新时期中国行政法治发展,有力地回应了现代法治政府建设的核心议题,不断朝着形式法治与实质法治相统一的方向迈进,从而为中国式行政法治现代化在中国特色社会主义新时代的深化拓展奠定了坚实基础,为强国建设、民族复兴提供了充满新的活力的政府治理法治保障,也为中国自主的行政法学知识体系的生成演进提供了重要理论与实践准备。
The new approach to the Chinese modernization of the administrative rule of law has a distinctive process in its creation,promotion and expansion.Since the reform and opening up,the Chinese modernization of the administrative rule of law has clearly presented a pattern of relay promotion with the socialist market economy as logical starting point,the rule of law concept evolution as ideological precursor,the administrative legal system construction as institutional cornerstone and the administrative trial practice as driving force.The reform of economic system called for the revolution of government governance,the enlightenment of the spirit of the rule of law guided the practice of administration according to law,the highly centralized control turned to the normal administration,the procedural administration according to law forced the substantive administration according to law.Based on these achievements,the Chinese modernization of the administrative rule of law has gradually come into being.It has effectively responded to the core issues of the modern lawbased government construction,and has continuously moved toward the unification of the formal rule of law and the substantive rule of law,thus laying a solid foundation for the advancement and expansion of Chinese modernization of the administrative rule of law in the New Era,providing a new and dynamic guarantee of the law-based government governance system for the construction of the great modern socialist country and the great rejuvenation of the Chinese nation,and providing an important theoretical and practical preparation for the generation and evolution of China’s independent administrative law knowledge system.
