摘要
为破解“企业污染、群众受害、政府买单”的困局,近年来,我国发布了一系列生态环境损害赔偿制度,保障公众的环境权益。加强环境损害鉴定评估工作,通过案例实践探索如何解决生态环境损害赔偿和修复问题,对落实环境公益诉讼和生态环境损害赔偿制度,具有重要意义。结合某尾矿库水毁事件案例在生态环境污染损害评估范围,损害调查、损害确认、环境监测、损害评估、损害数额量化等方面构建一整套程序和方法,同时探索其存在问题和发展建议,为我国生态环境污染损害评估提供参考和借鉴。
To break the predicament of"enterprise pollution,the masses being victimized,and the government paying the bill",in recent years,our country has released a series of ecological environment damage compensation systems to guarantee the environmental rights and interests of the public.Strengthening the work of environmental damage identification and assessment,and exploring through case practice how to solve the problems of ecological environment damage compensation and restoration,which has important significance for the implementation of environmental public interest litigation and the system of ecological environment damage compensation.The scope of the assessment,ecological environmental pollution damage investigation,damage recognition,environmental monitoring and damage assessment of a tailings flood event was analyzed and a set of procedures and methods to quantify the amount of damage and other aspects was constructed.Moreover,exploring the existing problems evaluation and development,as well as providing suggestion to the development of ecological environment pollution will support to assessment of environmental pollution damage in China.
