摘要
[目的/意义]作为知识产权信息公共服务体系的重要组成部分,技术与创新支持中心(TISC)积极开展微观专利风险预警一般方法研究有助于知识产权强国战略加速推进。[方法/过程]以用户需求为出发点和落脚点,建立微观专利风险预警的一般流程图和流程表,并根据司法解释的变化和用户专利分类管理的现实需求构建微观专利侵权风险评价和专利分类指标体系,以及相应的风险应对方案。通过案例验证,形成普适性的微观专利风险的分析流程和风险应对方法。[结果/结论]从微观层面形成专利风险预警的标准方法,科学揭示当前专利的侵权警度,并进行应对策略探讨。该方法可以支持项目组、个人等微观层面的专利风险研判和管理工作,并支持动态的专利风险监测。
[Purpose/Significance]As an important part of the public service system of intellectual property information,the micro-patent risk early-warning research in TISCs will help accelerate the development of the strategy of strengthening the country with intellectual property.[Method/Process]The general flow chart of micro-patent risk early-warning is established,taking the needs of users as the starting point and foothold.Moreover,the micro-patent infringement risk evaluation and patent classification index system are constructed to meet the changes in judicial interpretations and the realistic needs of users’patent classification management.The corresponding risk response scheme is also formulated.Finally,a universal process of analysing micro-patent risks and risk response methods are developed through case validation.[Result/Conclusion]The standard methodology of patent risk warning is formed at the micro-level to scientifically reveal the current infringement alert of patents and to discuss response strategies.The method can support project teams,individuals and other micro-level patent risk research and management,and support dynamic patent risk monitoring.
