摘要
认罪认罚从宽作为“十三五”规划的重要制度成果,实现了刑事诉讼程序的繁简分流,解决了实践中的一些难题。但该制度在运行过程当中也存在不足之处,特别是对被害人权利保护有所欠缺。在审视我国认罪认罚制度的构建时,其核心倾向明显偏向于对被追诉人权利的保护,而被害人的权益保障则显得较为边缘化。鉴于此,制度的持续优化应着重强化被害人权利保护机制,以防范社会矛盾的进一步积聚与激化。立足于认罪认罚制度下被害人权利保护的基础理论以及该制度实施现状,明确对被害人权利保障的必要性,进而分析目前认罪认罚制度中被害人存在知情权保障不足、赔偿范围狭窄、上诉权未确立等不足之处,最终提出旨在完善被害人权利保障体系的建议,以期推动认罪认罚制度向更加公正、合理的方向发展。
As an important institutional achievement of the"13th Five-Year Plan,"the leniency system for pleading guilty and accepting punishment achieves the streamlining of criminal proceedings and resolves some practical difficulties.However,there are deficiencies in the operation of this system,especially in the protection of victims'rights.When examining the construction of China's leniency system for pleading guilty and accepting punishment,its core tendency is obviously biased towards the protection of the rights of the prosecuted,while the protection of victims'rights appears relatively marginalized.In view of this,the continuous optimization of the system should focus on strengthening the protection mechanism for victims'rights to prevent further accumulation and intensification of social contradictions.Based on the basic theory of victims'rights protection under the leniency system for pleading guilty and accepting punishment and the current implementation status of this system,the necessity of protecting victims'rights is clarified.Furthermore,the deficiencies in the current system for victims,such as insufficient protection of their right to know,narrow compensation scope,and lack of an established right to appeal,are analyzed.Finally,suggestions aimed at improving the victims'rights protection system are proposed to promote the development of the leniency system for pleading guilty and accepting punishment in a more just and reasonable direction.
