摘要
建设工程招标投标因影响重大、流程复杂、利润高等原因,串通投标违法犯罪行为屡禁不止。以主体、犯罪构成要件、前置行政法为标准,对是否构成串通投标犯罪加以识别后可知,建设工程串通投标犯罪预防面临制度构建不完善、内部监管不健全、外部监督不到位的现实问题。应当完善建设工程招投标体制机制,健全企业内部监管体系,强化外部监督力度,从而有效防范建设工程串通投标违法犯罪行为的再次发生。
The illegal and criminal acts of collusive bidding for construction projects are frequently prohibited due to their significant impact,complex processes,and high profits.Based on the main body,the constituent elements of the crime,and pre-administrative law,it is evident that preventing collusive bidding in construction projects faces practical problems such as an imperfect system,inadequate internal supervision,and insufficient external supervision.Therefore,we should improve the bidding system and mechanism of construction projects,enhance the internal supervision system within enterprises,and strengthen external supervision to effectively prevent the recurrence of illegal and criminal collusive bidding activities.
