摘要
电子数据作为网络信息时代的“证据之王”,其所承载的案件事实可以解决刑事案件中的专门性问题。为最大限度发挥电子数据在案件事实认定中的积极作用,助推电子数据鉴定实现从科学事实认定向法律事实认定的转化,有必要对影响电子数据鉴定的潜在风险因素进行梳理分析。基于危险性分析法,对影响电子数据鉴定质效的鉴定人、鉴定程序与方法、鉴定运行的环境三层面风险致因展开多维度、多因素探析,初步范畴化电子数据鉴定风险的内涵构成,为电子数据鉴定的质量监控研究提供有益思考。
As the“king of evidence”in the era of network information,electronic data carries case facts that can solve specialized issues in criminal disputes.In order to maximize the positive role of electronic data in case fact determination and promote the transformation of digital forensics from scientific fact determination to legal fact determination,it is necessary to sort out and analyze potential risk factors that affect digital forensics.Based on the hazard analysis method,a multidimensional and multi factor risk analysis is conducted on the three risk factors that affect the quality and effectiveness of digital forensics,including digital forensics authenticator,digital forensics procedures and methods,and digital forensics operating environment.In the risk assessment process,the connotation and composition of digital forensics risks were preliminarily categorized,providing useful insights for quality management of digital forensics.
