摘要
随着我国进入轻罪治理时代,醉驾型危险驾驶罪入罪门槛低而出罪模式有限,刑事规范和政策调控对醉驾犯罪惩治的边际效应逐渐显现,从正当性角度出发,醉驾案件附条件不起诉契合法律理念并有相关法律法规支撑;在实践探索方面,各地区近年来对情节轻微的醉驾案件所尝试的“相对不起诉+”处理模式,实质上属于附条件不起诉。未来应发挥刑事诉讼的程序法优势,探索醉驾案件适用附条件不起诉制度,推动构建中国特色轻罪诉讼体系。我国醉驾案件适用附条件不起诉制度,可以从扩展附条件不起诉的适用范围,明确醉驾案件适用附条件不起诉的条件,科学设置醉驾案件附条件不起诉的考察机制,加强醉驾案件附条件不起诉相关人的权利保障等方面加以构建。
As China enters the era of misdemeanor governance,the threshold for criminalizing dangerous driving in drunk driving is low and the mode of excluding offenses is limited.As a result,the marginal effect of criminal norms and policy regulation on the punishment of drunk driving crimes is gradually emerging.From the perspective of legitimacy,the conditional non-prosecution of drunk driving cases is in line with the legal concept and supported by relevant laws and regulations.In terms of practical exploration,the"relative non-prosecution+"processing model attempted by various regions in recent years for cases of minor drunk driving is essentially a conditional non-prosecution.In the future,we should leverage the advantages of criminal procedure law,explore the application of the conditional non-prosecution system in drunk driving cases,and promote the construction of a Chinese characteristic minor crime litigation system.The application of the conditional non-prosecution system in drunk driving cases in our country can be constructed by expanding the scope of application of conditional non prosecution,clarifying the conditions for applying conditional non prosecution in drunk driving cases,scientifically setting up the inspection mechanism for conditional non-prosecution in drunk driving cases,and strengthening the protection of the rights of relevant parties in conditional non-prosecution of drunk driving cases.
