摘要
风险社会下,单一救济性环境行政公益诉讼难以应对新型环境风险,预防型法治的司法形态已成大势所趋。预防性环境行政公益诉讼虽被许多学者所提倡,但其构建的规范空间与程序空间狭窄,亦非应对环境风险的最佳策略。根据行政权保护优先理论与检察监督理论,诉前程序相较诉讼程序更能发挥预防性功能,宜将诉前程序构造为应对环境风险问题的主渠道,以诉讼程序为后备与补充。为充分激活诉前程序的预防性功能,应当拓展诉前程序的参与主体,降低检察建议的制发门槛,贯彻检察建议跟踪监督机制,以司法权与行政权的良性互动实现对生态环境公共利益的全方位保护。
In the context of a risk society,a single relief-oriented environmental administrative public interest litigation is difficult to cope with new environmental risks,and a preventive rule of judicial law has become the trend.Although the construction of preventive environmental administrative public interest litigation is advocated by many scholars,but its normative and procedural space is narrow,and it is not the best strategy to deal with environmental risks.According to the theory of administrative power protection priority and procuratorial supervision theory,pre-litigation procedures can better play a preventive function than litigation procedures,and should be constructed as the main channel to deal with environmental risk issues,with litigation procedures as backup.In order to fully activate the preventive function of pre-litigation procedures,the participating subjects of pre-litigation procedures should be expanded,the threshold for issuing procuratorial suggestions should be lowered,and the tracking and supervision mechanism of procuratorial suggestions should be implemented.The benign interaction between judicial power and administrative power can achieve comprehensive protection of public interests in the ecological environment.
