摘要
搭建“综合服务模块”是大型互联网平台编织其生态系统以获取竞争优势的重要手段之一。该模块以公共服务和政务服务为主要内容,在给人们生产生活带来便捷的同时,也导致在反垄断执法中出现相关市场界定困难、新型的损害竞争行为难以规制等问题。背后的深层次原因是“综合服务模块”的嵌入致使大型平台的法律地位和其中的法律关系复杂化,给现有反垄断法规体系的适用造成了诸多障碍。然而,对平台企业进行大幅度拆分不可为也不能为。因此考虑将“综合服务模块”与平台中其他的盈利性业务进行分离,或者科以一定的社会义务,可以在一定程度上驯服平台这只“利维坦”。
Building“Integrated Service Module”is one of the important means for large-scale Internet platforms to weave their ecosystem to gain competitive advantage.This module focuses on public service and government service,which not only brings convenience to people’s production and life,but also leads to problems such as difficulties in defining relevant markets and regulating new behaviors that damage competition in antitrust law enforcement.The underlying reason is that the embedment of“Integrated Service Module”complicates the legal status of large platforms and their legal relations,causing many obstacles to the application of the existing antitrust law and regulation system.However,it is neither reasonable nor possible to break up the enterprises on the platforms significantly.Therefore,it is advised to separate the“Integrated Service Module”from other profitable businesses on the platform,or impose certain social obligations on the Module,which may tame the“Leviathan”to a certain extent.
