摘要
现藏于乐山市档案馆的《盐业档案》保存了一些盐务机构租赁房屋的案卷。藉此可知,民国后期因时局动荡对经济的消极影响,盐场的房荒问题突出。盐务机构租赁房屋的范围是距离县城约40~50 km的场市。房屋租约可分为自由式与标准式两类,二者交相互用。盐场租约要素完整,包括立佃约人、标的物、租期、房屋用途、权责等。从租约内容看,盐场租约深受房屋租赁法规与租赁惯习的影响。在民国后期的租房实践中,大量出现加租续约、实物计租、承租人负担工料费、房主收回房屋自用等情形,表明在时局动荡之下房屋租赁法规与实际运行之间存在严重背离。
The Salt Industry Archives currently stored in the Leshan Archives preserve some files concerning the leasing of housing by the salt administration authorities.Accordingly,in the late period of the Republic of China,due to the negative impact of the turbulent situation on the economy,the issue of housing shortages in salt fields became prominent,leading to frequent housing rental transactions.The location of housing leasing for salt administration authorities is a market approximately 40 to 50 kilometers away from the county.Housing leases can be divided into the free type and the standard one with the two used alternatively.The elements of the salt fields lease are complete,including the tenant,the subject matter,the lease term,the purpose of the house,rights and responsibilities.In terms of the content of the lease,the salt fields lease is greatly affected by housing rental regulations and customary practices.In houses renting of the late period of the Republic of China,there were a large number of practices such as renewal of the lease with increased rent,rental payments based on actual goods,lessees bearing labor and material costs,and homeowners reclaiming the property for personal use,indicating a serious discrepancy between housing rental regulations and their practical implementation under the turbulent situation.
