摘要
罪犯会见权的有效行使可使罪犯即便身处封闭环境之中,亦能同社会保持相对稳定的联系,不仅有利于罪犯的再社会化,也可有效避免其监狱人格的形成,从而促进社会整体和谐稳定。现阶段,罪犯会见权在实践中不同程度地暴露出立法不全、程序不严、效果不佳等问题,未能深度契合全面依法治国,有必要在立法、刑事执行、社会参与等方面对罪犯会见权保障有关问题展开探讨。
The effective exercise of the right of visitation in prison can enable convicts to maintain relatively stable ties with society even if they are in a closed environment,which can not only help the resocialization of convicts,but also effectively avoid the formation of their prison personality,thus promoting the harmony and stability of society as a whole. At this stage,in practice, the right of visitation has been exposed to varying degrees of incomplete legislation,lax procedures,poor results,and other problems,which are not deeply in line with the comprehensive rule of law,and it is necessary to explore issues related to the protection of the right of visitation in legislation,criminal execution,and social participation.
