摘要
社区教育政策法律化是我国社会治理能力和治理水平现代化的重要体现。经过三十多年的发展,我国社区教育政策已形成较为复杂的规范体系,但这些政策规范尚未转化为国家层面的专门法律。当前我国社区教育政策法律化主要表现为地方性法规的制定,且以促进条例为主,存在法律政策化现象明显、稳定性不足等问题。我国社区教育政策应实现向法律的科学、民主、依法转化,出台国家层面的专门法律,以管理型法的出台为立法目标,走循序渐进的发展路径。
The legalization of community education policy is an important embodiment of the modernization of our country’s social governance ability and governance level.After more than 30 years of development,our country’s community education policy has formed a relatively complex standard system,but these policies and norms have not been transformed into special laws at the national level.At present,the legalization of community education policy in our country is mainly manifested in the formulation of local laws and regulations,and the promotion of regulations is the main problem,such as the obvious phenomenon of legalization and the lack of stability.The community education policy of our country must realize the scientific,democratic and legal transformation to the law.Our country should introduce special laws at the national level,take the promulgation of management law as the legislative goal,and take a gradual and orderly development path.
