数字平台集团自我优待行为的竞争法规制之反思 被引量:2

摘要 随着欧盟谷歌比较购物一案的发生,数字平台集团实施的自我优待行为引起了学界关注。自我优待行为这一概念所指代的范围被逐渐扩大,众多本可以被现有竞争法所规制的行为也被称为自我优待行为。围绕是否禁止实施自我优待行为的讨论也日益增多。文章经过对案例和现有研究进行检视之后,发现对自我优待行为不应简单予以全部否定。首先,应对常见的自我优待行为进行划分,将无法纳入现有竞争法规制的自我优待行为称为“自我优待行为”。其次,在全面分析“自我优待行为”的竞争效果后,应区别对待不同类型的“自我优待行为”,除了禁止具有市场支配地位的数字平台集团实施跨市场的“自我优待行为”之外,其余在横向市场、纵向市场和跨市场实施的“自我优待行为”应在符合“比例原则”的同时保护消费者选择利益。最后,注重发挥市场调研的作用,利用声誉机制促进消费者转换。 In the wake of Google comparison shopping case in the European Union,self-preferential behaviors carried out by digital platform groups have drawn academic attention.The range of behaviors designated by self-preferential behaviors has gradually been expanded;many behaviors that could be regulated by existing competition laws are also classified as self-preferential behaviors.The debate over whether to ban self-preferential behaviors is also heated.After reviewing the cases and existing studies,the paper has found that self-preferential behaviors should not be simply denied entirely.First,we should examine common self-preferential behaviors and categorize those that cannot be incorporated into existing competition law regulation as“self-preferential behaviors”.Second,after a comprehensive analysis of the competitive effects of“self-preferential behaviors”,we should differentiate between types of“self-preferential behaviors”.Except prohibiting digital platform groups with dominant market positions from implementing cross-market“self-preferential behavior”,other“self-preferential behaviors”in horizontal,vertical and cross-markets should conform to the“principle of proportionality”and protect the interests of consumers’choices.Finally,we should pay attention to the role of market research,and use the reputation mechanism to promote consumer conversion.
