摘要
健全自治、法治、德治相结合的乡村治理体系,须进一步建立传统文化与现代民主法治之间的联系,以乡村的内生性资源完善多元主体协同治理模式。乡贤文化介入乡村治理须打破“德治”的固化,形成乡贤文化的法治逻辑,实现乡村善治。借乡村共同体重构的视角,融合乡贤文化中的文化权威与社会权威,以法律权威搭建乡村共同体的法治基石。乡贤文化应立足于乡村法治文化失调现状,实现以法价值为核心的规则之治,规范乡贤文化主体;跳出“以德代法”误区,构建法理型乡贤组织;正视基层权威秩序的流变性,以法治保障动态调试下的新乡贤治理等,进而实现乡贤文化与法治乡村建设的同构与互嵌。
To improve the rural governance system of autonomy,rule by law and rule by virtue,it is nec-essary to further establish the connection between traditional culture and modern democracy and rule by law,and improve the multi-subject cooperative governance mode with the endogenous resources of rural ar-eas.The intervention of rural governance of rural sages culture must break the solidification of the category of"rule by virtue",build the legal logic of rural sages culture,and realize the good governance of villages.From the perspective of rural community reconstruction,the cultural authority and social authority in the rural sages culture are integrated to establish the legal foundation of rural community with legal authority.Rural sage culture should be based on the imbalance rule of law culture in the countryside,realize the rule of law with legal values as the core in order to standardize the subjects;avoid the misconduct of"tak-ing virtue as law"to build law-based sages organizations,and pay attention to the rheology of grassroots order of authority so as to guarantee new sages governance.Thus,it can realize the isomorphism and inter-penetration between rural sages culture and the construction of rule of law in the countryside.
